Summit Football Academy

Effective Date: March 21, 2025

These Terms and Conditions (“Agreement”) govern the participation in and use of services provided by Summit Football Academy (the “Academy,” “we,” “us,” or “our”). By enrolling a child, making a payment, or using our services, you (“Parent/Guardian” or “Participant”) agree to be bound by these terms. If you do not accept these terms, you are not permitted to enroll or use our services.

1. ENROLLMENT & PARTICIPATION

1.1. Eligibility: The Academy is open to players aged 10-17 years old. Parents/Guardians must complete all registration forms and provide accurate information before a child may participate.

1.2. Compliance: Participants and Parents/Guardians agree to comply with all Academy rules, policies, and instructions given by coaches and staff. Failure to comply may result in disciplinary action, including suspension or expulsion from the Academy without refund.

1.3. Player Conduct: Participants must demonstrate respect, discipline, and good sportsmanship. Disruptive behavior, violence, or misconduct will not be tolerated and may lead to immediate dismissal.

2. PAYMENTS, FEES & REFUNDS

2.1. Fees & Payment: All fees must be paid in full before participation. The Academy reserves the right to refuse participation if payments are not received.

2.2. Non-Refundable Policy: Payments are final. There will be NO REFUNDS under any circumstances, including injury, withdrawal, expulsion, or dissatisfaction.

2.3. Late Payments & Suspension: Failure to make timely payments will result in suspension of services until outstanding balances are cleared. The Academy reserves the right to pursue legal action for unpaid fees.

2.4. Chargebacks & Disputes: Any chargebacks or disputes initiated by a Parent/Guardian will be legally contested. All legal fees incurred in resolving payment disputes will be the responsibility of the disputing party.

3. LIABILITY WAIVER & ASSUMPTION OF RISK

3.1. Acknowledgment of Risk: Football is a physically demanding sport that involves inherent risks, including but not limited to injuries, falls, collisions, and physical contact.

3.2. Release of Liability: By enrolling in the Academy, you acknowledge and accept that Summit Football Academy, its owners, coaches, staff, and affiliates are NOT responsible for injuries, medical expenses, property damage, or any other losses incurred during training, matches, or Academy activities.

3.3. Medical Emergencies: In the event of an injury, we will make reasonable efforts to contact the Parent/Guardian. However, by enrolling, you authorize the Academy to provide emergency medical treatment if necessary. All medical costs are the sole responsibility of the Parent/Guardian.

3.4. Insurance: The Academy does not provide medical or accident insurance. It is the responsibility of the Parent/Guardian to ensure the player has adequate insurance coverage.

4. ACADEMY PROTECTION FROM DEFAMATION, HARASSMENT & PUBLIC ATTACKS

4.1. Zero Tolerance for Defamation & False Claims:

• Any attempt to slander, defame, or spread false information about the Academy, its staff, or its services—whether in person, online, or through any other medium—will result in legal action.

• The Academy reserves the right to pursue full damages, including legal costs, for reputational harm caused by false allegations or defamatory statements.

4.2. No Harassment of Coaches, Staff, or Other Parents:

• Any form of harassment, including verbal abuse, threats, or aggressive behavior towards Academy staff, coaches, players, or other parents, will result in immediate expulsion from the Academy without refund.

• We reserve the right to ban disruptive individuals from attending Academy sessions or events.

4.3. Social Media & Public Statements:

• Parents/Guardians are prohibited from making negative or misleading statements about the Academy on social media, online platforms, forums, or in public discussions.

• If you have concerns or issues, they must be addressed directly with the Academy through official communication channels.

5. INJURIES, TRAINING SAFETY & EQUIPMENT

5.1. Player Fitness & Medical Responsibility:

• Parents/Guardians confirm that the child is physically and mentally fit to participate in football training.

• Any pre-existing medical conditions must be disclosed during registration. Failure to disclose medical conditions may result in immediate removal from the program for safety reasons.

5.2. Protective Gear & Training Equipment:

• Players are responsible for wearing appropriate football gear, including shin guards, training kits, and football boots.

• The Academy is not responsible for any lost, stolen, or damaged equipment.

6. PHOTO & MEDIA CONSENT

6.1. Photography & Filming:

• By enrolling, you grant the Academy permission to capture photos and videos of players during training and matches for marketing, promotional, and educational purposes.

• If you do not wish for your child to be included in media content, you must submit a written request before the start of training.

7. TERMINATION OF SERVICES

7.1. Academy Rights to Remove Players:

The Academy reserves the right to expel or suspend any player at any time for:

• Disciplinary violations, misconduct, or failure to follow Academy rules.

• Non-payment of fees.

• Parental harassment, defamation, or disruptive behavior.

7.2. No Refunds for Termination:

• If a player is removed from the Academy for any reason, no refunds will be issued.

• The Academy reserves the right to refuse future enrollments from individuals who violate these terms.

8. INDEMNIFICATION & LEGAL PROTECTION

8.1. Indemnity Clause:

• By enrolling in the Academy, you agree to indemnify, defend, and hold harmless Summit Football Academy, its owners, staff, and coaches from any legal claims, liabilities, costs, or damages arising from participation in Academy activities.

8.2. Legal Jurisdiction:

• Any disputes arising from this Agreement shall be governed by the laws of Thailand (Hua Hin)

• Any legal claims against the Academy must be settled through mediation first. If mediation fails, legal action must be pursued in the courts of Thailand (Hua Hin)

9. CHANGES TO TERMS & CONDITIONS

9.1. Academy Rights to Update Terms:

The Academy reserves the right to modify these Terms and Conditions at any time. Updates will be posted on our website and take effect immediately upon posting. Continued participation in the Academy constitutes acceptance of the updated terms.
